By accessing or using Kodu.ai's services, including the Claude Coder VSCode extension and the Engineer voice agent product (collectively, the "Services"), you agree to be bound by these Terms of Service.

To use our Services, you may need to create an account using Clerk authentication. You are responsible for maintaining the confidentiality of your account information and API keys. You agree not to share your API keys or account credentials with any third party.
Use of disposable, redirector, spam, bot, or fraudulent email addresses, as well as disposable or VoIP phone numbers, is prohibited. If we detect such usage, we reserve the right to deduct 20 credits from your account. If you wish to use such contact information, please contact us directly at [email protected].
New users receive $10 worth of free credits for use with the Claude Coder extension. This goes up to $12.5 if they have been referred by someone. Once these credits are exhausted, you may be required to purchase additional credits to continue using the Services. We reserve the right to modify our pricing and credit system at any time.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not use the Services to violate any applicable laws or infringe on any third-party rights.
The Services and their original content, features, and functionality are owned by Kodu.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.1. Ownership: You retain all rights, title, and interest in and to any data or content you submit or generate while using our Services.
7.2. Service Functionality: Kodu.ai does not assert any ownership rights to your data or content.
7.3. Data Usage for Service Improvement: In order to enhance the accuracy and effectiveness of our Kodu Engineer product, we may collect Kodu Engineer data such as sanitized prompts and outputs. This process is designed to improve model performance and user experience.
7.4. Opt-In/Opt-Out: We will provide mechanisms for users to opt in or out of data collection for service improvement purposes. These options will be clearly communicated and easily accessible within our Services.
7.5. Future Community Support: In the future, we may introduce additional opt-in programs that allow users to contribute sanitized and anonymized data to support the broader user community. Such programs, if implemented, will be entirely voluntary and subject to separate terms and conditions.
7.6. Data Protection: Any use of user data for service improvement or community support will be conducted in strict accordance with our Privacy Policy, employing robust anonymization and sanitization techniques to protect user privacy and intellectual property rights.

Kodu.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Services.

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach the Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
